Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TalktoFit mobile application, the Apple Watch companion app, website, and related services (collectively, the "Service") operated by Mustafa Cihat Aykaş ("TalktoFit", "we", "us", or "our").

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

TalktoFit helps you log workouts, save routines, track training and body-weight progress, view reports, and interact with an AI coach. On iPhone you can log manually, by voice, or by text. A paired Apple Watch supports workout controls, set editing, voice input, and live health readings. Voice input is transcribed on your device; the resulting text and relevant context are processed by our backend and AI providers. The coach can answer questions, suggest or apply workout changes, and help create training programs. Where available, generated replies can be read aloud. The Service is for personal fitness tracking and informational purposes only. Features depend on your device, app version, language, and subscription.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are under the age of majority where you live, you may use the Service only with permission of a parent or legal guardian who accepts these Terms on your behalf.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep your account information up to date. Notify us promptly at hi@talktofit.app if you suspect unauthorized access.

You may delete your account in the app (Profile → Danger zone → Delete account) or by contacting us. Successful deletion removes your account and linked database records and cannot be undone. Profile-photo removal, third-party records, backups, and local files are subject to the details in our Privacy Policy. Deleting your account does not cancel a store subscription.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws;
• Attempt to gain unauthorized access to the Service, other accounts, or our systems;
• Reverse engineer, decompile, or attempt to extract source code except where permitted by law;
• Interfere with or disrupt the Service, including by automated scraping or excessive requests;
• Circumvent Pro access controls, usage limits, or other technical measures;
• Upload malicious code or content that infringes others' rights;
• Misrepresent your identity or affiliation.

5. Subscriptions, Pro features, and usage limits

Starting a new workout, voice workout logging, and AI coaching require active TalktoFit Pro access, including an eligible active trial. Starting a new workout requires Pro even when you intend to log manually or by text. Access to existing records and controls for an already-started workout may differ from access to new workouts and AI features. The app displays the applicable access requirements; we may change which features require Pro.

Subscriptions are billed through the Apple App Store or Google Play Store (as applicable) and managed via our subscription provider. Pricing, billing period, free trial terms (if offered), and renewal details are shown at the time of purchase.

• Auto-renewal: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period through your app store account settings.
• Cancellation: You can manage or cancel subscriptions in your Apple or Google account. Deleting the app or your TalktoFit account does not cancel your subscription.
• Refunds: Refund requests are handled by Apple or Google according to their policies. We do not control store refund decisions.
• Fair-use limits: To keep the Service reliable, we apply daily and short-term limits on transcript processing, AI coach messages, and related features. Pro access is subject to these limits and service availability. Limits may change. Reaching a limit may temporarily block the affected feature until the limit resets or the app allows another request.

6. Health and fitness disclaimer

TalktoFit is not a medical device and does not provide medical advice, diagnosis, or treatment. Content generated by the Service—including written or spoken AI coach responses, training programs, estimated calories, body-weight trends, analytics, Apple Watch readings, and suggestions—is for general fitness and informational purposes only. Always consult a qualified healthcare professional before starting or changing an exercise program, especially if you have a medical condition, injury, or health concerns.

Apple Watch heart-rate and active-energy readings support the Watch experience. Recent heart-rate context may also inform in-session coaching when available. Readings can be delayed, incomplete, or unavailable; neither the Watch display nor AI coaching is a medical or emergency monitoring service. You assume the risks associated with physical activity, subject to rights that cannot be excluded by law.

7. AI, voice, and Watch features

Voice commands, on-device speech recognition, and AI coach outputs may be inaccurate or incomplete. You are responsible for reviewing saved workout entries, any changes the coach makes to an active session, and any training program before you apply or follow it. The coach may ask you to choose between options or clarify a command; review the resulting changes and use available editing or undo controls when needed. Coach personas and their synthetic voices represent AI experiences. Do not rely on the Service as a substitute for professional coaching or medical guidance.

The Apple Watch companion requires a paired iPhone with the TalktoFit app installed and a working connection between the devices. If the phone is closed, in the background, or unreachable, some Watch actions may be delayed or unavailable until the phone can process them.

Voice setup on iOS requires a compatible device and downloading an on-device speech model. You are responsible for the storage and network use this requires. If local speech recognition is unavailable, the current product does not fall back to cloud transcription. Even after setup, processing commands, generating coach replies or speech, and synchronizing data require a network connection. Spoken replies can be muted and may be unavailable for a particular language or configuration.

8. Intellectual property

The Service, including software, design, trademarks, exercise demonstration media, and content we provide, is owned by TalktoFit or its licensors and is protected by intellectual property laws. Your use of the Service is also subject to our End User License Agreement.

You retain ownership of workout data and content you submit. You grant us a limited license to host, process, and display that content solely to operate and improve the Service.

9. Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive termination will survive, including disclaimers, limitations of liability, and dispute provisions.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALKTOFIT AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Changes

We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence apply.
