Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TalktoFit mobile application and related services (collectively, the "Service") operated by Mustafa Cihat Aykaş ("TalktoFit", "we", "us", or "our").

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

TalktoFit is a voice-first workout logging application that helps you record exercises, track progress, view analytics, and interact with an AI coach. The Service is provided for personal fitness tracking and informational purposes only.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are under the age of majority where you live, you may use the Service only with permission of a parent or legal guardian who accepts these Terms on your behalf.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep your account information up to date. Notify us promptly at support@talktofit.app if you suspect unauthorized access.

4. Acceptable use

You agree not to:

Use the Service for any unlawful purpose or in violation of applicable laws;
Attempt to gain unauthorized access to the Service, other accounts, or our systems;
Reverse engineer, decompile, or attempt to extract source code except where permitted by law;
Interfere with or disrupt the Service, including by automated scraping or excessive requests;
Upload malicious code or content that infringes others' rights;
Misrepresent your identity or affiliation.

5. Subscriptions and payments

Certain features require a paid TalktoFit Pro subscription. Subscriptions are billed through the Apple App Store or Google Play Store (as applicable) and managed via our subscription provider. Pricing, billing period, free trial terms (if offered), and renewal details are shown at the time of purchase.

Auto-renewal: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period through your app store account settings.
Cancellation: You can manage or cancel subscriptions in your Apple or Google account. Deleting the app does not cancel your subscription.
Refunds: Refund requests are handled by Apple or Google according to their policies. We do not control store refund decisions.

6. Health and fitness disclaimer

TalktoFit is not a medical device and does not provide medical advice, diagnosis, or treatment. Content generated by the Service—including AI coach responses, analytics, and suggestions—is for general fitness and informational purposes only. Always consult a qualified healthcare professional before starting or changing an exercise program, especially if you have a medical condition, injury, or health concerns.

You assume all risks associated with physical activity. Use the Service at your own risk.

7. AI and voice features

Voice commands and AI coach outputs may be inaccurate or incomplete. You are responsible for reviewing workout entries before saving them and for using your judgment when following suggestions. Do not rely on the Service as a substitute for professional coaching or medical guidance.

8. Intellectual property

The Service, including software, design, trademarks, and content we provide, is owned by TalktoFit or its licensors and is protected by intellectual property laws. Your use of the Service is also subject to our End User License Agreement.

You retain ownership of workout data and content you submit. You grant us a limited license to host, process, and display that content solely to operate and improve the Service.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive termination will survive, including disclaimers, limitations of liability, and dispute provisions.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALKTOFIT AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Changes

We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence apply.
